GOVERNMENT DECREE
On the Issuance of the Regulation on the Management
and Utilization of Official Development Assistance
THE GOVERNMENT
In pursuance to the Law on the Organization of the Government promulgated on 30 September 1992;
Based on the Ordinance on the Conclusion and Implementation of International Treaties issued on 20 August 1998;
Considering the proposal made by the Minister of Planning and Investment, the Minister of Justice and the Minister/Chairman of the Office of the Government;
HEREBY DECREES:
Article 1: The Government shall, in conjunction with this Decree, issue the Regulation on the Management and Utilization of Official Development Assistance (hereinafter abbreviated as ODA).
Article 2: This Regulation shall come into force fifteen (15) days following the date of its signature and shall supersede Decree 87/CP issued by the Government on 5 August 1997 on the issuance of the Regulation on the Management and Utilization of Official Development Assistance.
Article 3: Within three (3) months following the date on which this Decree comes into force, all issues relating to the attraction, management and utilization of ODA as well as the implementation of ODA projects/programmes which have been approved prior to this effective date shall be adjusted in line with the provisions of this Decree.
Article 4: The Minister of Planning and Investment, Minister of
Finance, Minister of Foreign Affairs, Governor of the State Bank and Heads of other relevant Ministries, Branches and Organizations shall be responsible for guiding and examining the implementation of this Decree.
Article 5: Ministers, Heads of ministerial-level agencies, Heads of agencies directly reporting to the Government, Chairmen of People’s Committees of provinces and centrally managed cities, Heads of other relevant organizations shall be responsible for implementing this Decree.
